UGC Policy — User-generated content (VAINKEURZ)

1) Purpose

This policy describes the rules applicable to content published by users on VAINKEURZ hereinafter referred to as " Content "), as well as the procedures for reporting and moderation.
It supplements the Site's Terms of Use.

2) Scope of application

The following, among other things, are considered Content:

  • tops, rankings, titles, descriptions;
  • related comments and messages;
  • images/illustrations, avatars, and any files or elements published by the user (if applicable).

3) Publication principles

VAINKEURZ a platform focused on pop culture and entertainment. Users agree to publish Content:

  • loyal, respectful, and in keeping with the spirit of the Site (fun, friendly);
  • compliant with applicable laws and regulations;
  • without infringing on the rights of third parties.

The user remains solely responsible for the Content they publish.

4) Prohibited content

It is prohibited to publish, transmit, or make available any Content, in particular when it:

4.1 Is illegal or harmful to individuals

  • defamatory, abusive, harassing, humiliating, or threatening content;
  • incitement to hatred, discrimination, or violence;
  • advocacy of crimes, violence, or dangerous behavior;
  • content that is sexually explicit or harmful to minors.

4.2 Infringement of third-party rights

  • infringement of copyright, trademarks, related rights, trade secrets;
  • infringement of image rights or privacy (e.g., publication of a third party's personal data without authorization: name, email, address, number, social media accounts, etc.);
  • impersonation or deception regarding the origin of the Content.

4.3 Disrupts the proper functioning of the Service

  • spam, unauthorized commercial solicitations, malicious links;
  • attempted intrusion, automated or mass extraction of data, circumvention of technical measures;
  • artificial manipulation (multiple accounts, behavior intended to distort votes, rankings, or results).

4.4 Is off-topic or at risk of drifting off topic

VAINKEURZ the right to moderate or remove Content:

  • too far removed from pop culture/entertainment themes;
  • likely to generate abuse (divisive content, inciting hateful or abusive reactions), even if they are not necessarily illegal.

5) Specific rules — Images and illustrations

If the user publishes an image/illustration:

  • he guarantees that he has the necessary rights (license, authorization, public domain, etc.);
  • he/she undertakes to comply with the terms of use of third-party websites/image banks, where applicable;
  • It undertakes to remove/update any Content in the event of a dispute based on the rights of a third party.

6) Reporting content

Any user or third party may report Content that they consider to be illegal or non-compliant.

To facilitate processing, please indicate:

  • the URL of the Content (or an identifier/screenshot);
  • a description of the problem (defamation, hate speech, IP infringement, image rights, personal data, etc.);
  • any useful information (proof of ownership of rights in the event of IP infringement, or justification in the event of image/privacy rights).

7) Handling reports and moderation

VAINKEURZ intervene at any time, particularly in the event of a report, to:

  • request a modification of the Content;
  • limit the visibility of the Content (delisting/hiding);
  • remove the Content;
  • restrict certain features;
  • suspend or delete an account in the event of repeated or serious violations.

Moderating measures may be taken in the following cases:

  • of manifestly unlawful Content;
  • violation of the Terms of Use or this policy;
  • abuse or fraud;
  • serious risk to users or the Service.

8) User information and disputes

When Content is removed or an account is restricted, VAINKEURZ inform the user concerned of the reasons for the decision, except where prohibited by law or security requirements (e.g., fraud prevention, investigation, risk of abuse).

9) Retention and evidence

In the event of a breach of these rules, VAINKEURZ the right to:

  • remove the relevant Content;
  • temporarily limit certain features;
  • suspend or delete the account;
  • and, if necessary, take any appropriate action.
