Access to the VAINKEURZ service VAINKEURZ hereinafter the “Service”) is subject to the User’s compliance with the Terms of Use set forth below (hereinafter the “Terms”). We recommend that you review the Terms each time you visit this website, as they may be modified at any time without notice.

ACCEPTANCE OF THE TERMS AND CONDITIONS OF USE

Use of the Service—whether it is free or requires registration and the creation of an account to participate in compiling the top lists—implies the User’s agreement to comply with the Terms of Service.

If access to the Service is free of charge, it may be suspended or terminated due to misuse of the services. Any renewal of such free access shall be subject to the express consent of VAINKEURZ.

Depending on how the Service is used, the User may be required to create posts; in such cases, the User must ensure that:

• to agree to the terms of use of third-party websites from which they may download images for use in creating their tops;
• not to infringe upon the intellectual property rights of the rights holders of these illustrations;
• not to use images that could damage the honor or reputation of individuals or legal entities;
• to adhere to the themes of the lists, namely the world of pop culture. Top lists that are divisive, overly political, or likely to provoke hateful or abusive reactions may be removed.
  Use of the Service—whether free, open to the public, or requiring account creation—is intended for reasonable and normal use, in line with VAINKEURZ values VAINKEURZ having fun in a playful and friendly way while sharing our love of pop culture.

In connection with this activity, VAINKEURZ a content host within the meaning of the Law on Confidence in the Digital Economy of June 21, 2004, and does not conduct any prior review of the rankings published on its website.

ACCESS TO THE SERVICE

VAINKEURZ to use all reasonable means to provide the User with reliable and fast access to the Services.
The User acknowledges and accepts the costs and limitations inherent in any Internet connection. The User, having been informed of the minimum specifications provided by VAINKEURZ, is responsible for accessing the Service under appropriate technical conditions—hardware, software, telecommunications—to ensure, in particular, that all security measures are in place and that protection against potential intrusions is maintained.

The information on this website is available 24 hours a day, 7 days a week, subject to any accidental interruptions or those necessary for the proper functioning of the service.
No compensation will be provided for such interruptions.

TERMINATION

VAINKEURZ terminate the Service at any time.

In the event of a breach of the obligations set forth herein, VAINKEURZ the right to delete the registered User’s account, prevent the User from re-registering, and take any action and/or legal recourse necessary to put an end to any infringement of its rights and to obtain compensation for the damages suffered.

The Site will process the User’s cancellation request as soon as possible.

INTELLECTUAL PROPERTY

All text, logos, and images to which the Site provides access as part of the Service are protected by copyright and database rights, in accordance with the Intellectual Property Code.

The User agrees not to use the Service for any purpose other than purely recreational, and further agrees not to publish, distribute, or sell, in any manner whatsoever, the content to which they have access, or, more generally, to infringe upon VAINKEURZ rights in any way.

Subscribing to any form of access (such as creating an account or adding favorites) to the Service does not result in any transfer of ownership rights of any kind to the User.

The User further agrees not to infringe in any way upon the rights of reproduction, public performance, and other rights held by the Site and by third-party sites, including pursuant to Articles L.342-1 et seq. of the Intellectual Property Code relating to databases.
The User shall refrain from any reproduction, extraction, or reuse of the database content that is substantial in nature or volume, as well as from the repeated and systematic extraction or reuse of parts of the database content that are not substantial in nature or volume.

Any other use not provided for in the Intellectual Property Code is subject to prior written authorization from VAINKEURZ.

The obligations set forth herein shall remain in effect for the entire duration of the intellectual property rights to the Site and in all countries, including after the termination of the contract.

By posting content on the Site, the user grants VAINKEURZ license to use such content for the purpose of utilizing it within the Service and distributing it to Users via the Sites and/or Applications.

LIABILITY

The User is solely responsible for viewing, selecting, using, and interpreting the rankings displayed on the Site.

When they take the initiative to create a Top, they shall ensure that, at all times, the information necessary for the proper functioning of the Top is accurate, does not infringe upon the rights of third parties, contains no disparagement or defamatory statements, is not contrary to public decency, does not infringe upon privacy or public order, and does not violate provisions relating to press laws and the protection of minors.
The Top may be customized in accordance with the Site’s graphic charter and its distinctive features.

The Host cannot be held liable for a Top created by a User, either toward third parties or toward the User, unless the Host has been notified of a clearly illegal infringement of rights.

The User is solely responsible for access to the Service, and any use made of it prior to the modification or cancellation of access credentials remains the User’s responsibility.

PRIVACY – PERSONAL INFORMATION

The information collected when creating an account is used solely to allow the User to access the previous polls in which they have participated.
Only the User’s email address is collected; the User is free to choose their username and add an avatar.

This usage data is collected solely to improve the user experience.

GOVERNING LAW – JURISDICTION

These Terms of Use are governed by French law.

In the event of a dispute, the courts of Paris shall have exclusive jurisdiction, in accordance with the applicable rules of procedure.
